Moving with Open Custody Case

HI!

So i have been separated from the father of my child for over a year now. We started with a mutual agreement of 50/50 legal and physical custody. I then was not thrilled with his living situation as he moved in with his now current girlfriend who has three children and it was effecting my child’s behavior, sleeping patterns etc. The father immediately got a lawyer and filed for temporary orders, to go back to 50/50 custody. That is what is currently happening the mediator decided it would be best. We have a court date set for May 2016.

My current boyfriend and myself currently live a hour away from each other, we want to start looking in to a house or apartment so we can stop traveling. We are looking to move half way between each other, which means a half an hour away from my child’s father.

I am worried about this due to the custody case still being open, I don’t want to hurt my chances of it either staying 50/50 custody or when he is going to need to change school systems, his father being given full custody cause it is me that is moving away,

I have always been the sole care giver to my son, I go to all doctors appointments, pick him up from school, hair cuts, school events etc.

Any advise would help!

Currently I do not have an active lawyer for this case as the one I has hired for the temporary orders did nothing to help my case. I am looking for a new one, but would love some insight or piece of mind. Thanks!
