My mother passed away two years ago this upcoming September. I was sent one form which I believe was supposed to relinquish my rights of claim over the estate, I refused and that’s a last I’ve heard of it. How would I start a petition for probate court or investigate whether or not my stepfather defrauded, myself, his daughter, my half-sister, and Massachusetts. I being my moms oldest of two children. She had two cars, a residence in pembroke a business in marsh field and partial ownership of land and a cabin in the upstate New York . Any suggestions?

You really don’t want to wait any longer. If your mother had a will, then the will should dictate who is appointment personal representative of the estate. If there was no will, or if the designation personal representative has taken no action, then you may want to consider petitioning the probate court for your appointment. The first thing you want to do is research the probate court in the county where your mother resided at the time of her passing. Unfortunately, I think you are going to need an attorney to assist you in determining what action has been taken thus far and whether it was lawful.
