MA Real Estate Law Questions and Answers
We have 2 deeded tandem parking spots. A new owner purchased a condo in the building. He parks next to us and his spot is for a compact car. He and his girlfriend park in the spots but their cars do not fit so he is either over the yellow line or on it. It has made it difficult for me to get in and out of my car unless I strategically park it and risk hitting a pole. What are our rights? We have spoken to him several times and he says he will park it in the spot, but realistically his car and his girlfriends are not compact, so they will not fit.

Dear Condominium Unit Owner,
If your neighbor is parking over the line, then it sounds like he is trespassing.
If his car is too big, then in my view, it is his problem. It shouldn’t be your problem.
You should probably have an attorney draft a letter to him.
In a nutshell, such a letter would warn him that he is trespassing, and that unless he stops, you will sue him.
You are welcome to contact me to discuss further.
Yours truly,
