No, an uncontested divorce requires both parties to agree on the divorce and the property division, otherwise it must go the 1B Contested route. However, the fact that one party does not want to divorce will not stop the divorce, but it will force the procedure to go through the contested route. Typically, it is best for the higher earning spouse to complete the divorce as quickly as possible, in order to minimize alimony and other monetary effects.
