Original condo unit owner of a total renovation.conversion of 2-unit apartment building looking for builder (previous owner)

I am owner of one unit in 2-unit condominium that was totally renovated and converted fro two rental apartments last fall. The builder ( conversion owner and renovator) paved an additional area of parking lot to provide a nice-looking additional parking spot. This was last October, 2017. That added spot already (late March, 2018) has grass popping through that new pavement area! Looks like the builder/owner just paved over some grass, turf or dirt and did not properly prepare the ground under the asphalt with stone or gravel. Does the renovator/earlier owner/builder have a duty to warrant or repair this now under a one-year workmanship warranty (implied or expressed)? Thanks.
