Recently I received a letter, as personal representative of a relatives intestate estate from the MassHealth Estate Recovery Unit stating that a Notice of Claim for X dollars had been filed with the probate court. The relative’s estate, though small, has an inherited interest in a piece of property, along with siblings, that exceeds the amount of claim.
In a conversation with the case specialist at MassHealth I was told that it is possible to lower the figure of claim by factoring in things such as property taxes, improvements made to the property, repairs, etc., made over about 25 years. I have not been able to find a definitive list, or guidance regarding this matter. Can anyone cite references for the information I’m looking for, or offer substantive advice? Thank you.
