Was cited with 89/9 for failing to offer right of way at an intersection when a truck pulled out of a parking lot and hit the right side of my car. Just prior to this the road is a single lane, but widens and cars begin forming two lanes or being to travel into their intended lane. The opening for the parking lot is forty feet prior to the solid white line . Traffic in right lane was pulled over close to the sidewalk and stopped to to approaching red light at intersection. I looked in my left mirror to make sure no one was already traveling in the left lane and when there was not, I moved into the left lane and began passing vehicles that were stopped and stopping on my right. One vehicle had stopped just before the opening of the parking lot and as I was passing this location a truck emerged and his my right side. I was knocked out and taken to the ER. Police never spoke with me and subsequently began a two week vacation. I learned of the citation when I picked up police report. Report referenced only one witness although there were three that made themselves know to me when trying to aid me. I spoke with one that was on police report and he said he told police truck hit me and denied I entered into the left lane too early. The accident occurred forty feet from where the solid white line commences prior to the intersection. That is less then two of my truck lengths. Since you are not supposed to cross a solid white line, when are you allowed to begin entry into the proper lane when there is room to do so? Police say I was at fault because I wasn't in a legal lane even though MA law says vehicle departing parking lot, private way must afford oncoming vehicles right of way. Truck leaving parking lot was apparently attempting to take left turn. He reached the intersect after me as he hit me on right side. Very confused about why I am cited. Can you comment on when it is proper to enter into new lane when there is no preceding broken white lines or no passing signs? Thank you.
