Full time Employee, live in superintendent in Massachusetts, took another full time job for which he had been working during the same hours we were paying him. When only recently this became apparent, the employee gave notice. Do I have recourse to withhold payment or to sue for funds paid out while said employee was employed by both companies and apparently not working for me?
