Can last months rent and security be used if a tenant dies?

My tenant was brought to the hospital first week of December and diagnosed with terminal illness and died December 22 nd. Her son paid the December rent but now January rent is due. My tenant has a tenant at will. Her younger son wishes to stay in the townhome and continue to pay rent although he was not on the lease. He has asked that his mothers last months rent be used to pay January and then he would sign a new tenant at will lease. I know nothing about this person and he is now in my townhome. Do I use the last months rent for January so the family can remove the belongings? Do I request a credit application and new lease with first and last of the son if he wishes to stay there? Does he have a right to be there now?
