I've recently won a summary judgment in Bankruptcy court in Massachusetts. Assuming that the defendant/debtor doesn't appeal within the 30 day period, I'm trying to pin down the exact procedure for garnishing her wages.
It looks as though I can send interrogatories under M.R.C.P. section 26 to ascertain her employer and wages. And I know I need to submit a writ of execution to the U.S. Marshal's office to enforce the judgment.
I'm a bit puzzled about the MIDDLE step. however. Most states seem to require an "Order for Earnings Withholding" from the court, but I can't seem to find an official form to request that. Do I need to write my own "Motion for Order for Earnings Withholding" from scratch, or is there something I'm missing?
Also, while many other states seem to have templates online for writing the Writ of Execution itself, I can't seem to find one for Massachusetts. Any suggestions there?
