Basically i bought a car that had a $8k rebate advertised. I followed the terms of the rebate and the rebate hasn't arrived and the company's phone is disconnected.

I made a complaint to the mass attorney general and BBB. However, I don't have faith that they will resolve this matter. So if I hired an attorney to help...

1. can a lawyer help me?
2. what kind should i call?

background - this is a blurb is sent to the mass attorney general:

On 11/3/02 I purchased a car from xxx. I understood that I would be receiving a rebate for $8012 from Cashback America. I sent in the forms, waited 54 months and requested the rebate by FedEx on 5/24/07. I followed all terms of the rebate.

After several months I became quite concerned that my rebate had not arrived. I called CBA and the phone would ring with no answer. I have called repeatedly without answer and now the phone is disconnected. I emailed the CBA through their website in November 2007 and received a response that they would notify me about the status of my rebate. I have continued to email and have received no further response. I found that your office was/is investigating these rebate companies.

I would not have purchased my car without this rebate. I believe xxx advertised this promotion without caring if the rebate company was legitimate. I was scammed by CBA and xxx. I need assistance getting my rebate for $8012.

This sounds like a 93A claim against both the dealership and the rebate company. 93A is the Mass COnsumer PRotection law - this law could allow you to seek triple damages and attorney's fees if successful. There is lots of information about this law on the Mass.gov website.

Any attorney who litigates can handle this. My firm does not litigate, but I would be happy to recommend an attorney for you.

thank you, a recommendation would be appreciated.

i did send a packet off to the mass attorney general's office - consumer complaints, yesterday, however, i feel like i'm sending things to a black hole and don't really expect a response. of course if i get one, i'd be thrilled.

one big problem is that the rebate company's phones are disconnected, their website is down, i wonder if they have disappeared.
