My landlord sent me a notice to quit in May ending the tenancy on 6/30/08. I am not leaving due to my claims of retaliation. I sent him a money order for July's rent clearly stating July's rent on it. I just received a letter in the mail from Landlord stating this check will be used for "occupancy rent" only. From what I can gather it can only be used for "use and occupancy" or "arrears". And I believe they have to tell you that at the time. They sent this letter one week after the fact. and does it make a difference that they wrote "occupancy rent"?
