Is He Responsible for Friend Overdosing?

10-Jul-2008 1:03 PM -- Anonymous

What happens when two young friends, guys in their 20's, get together for a night of partying and they both decide to do drugs and one overdoses and dies? Is the other guy responsible?

They were very good friends through high school and when this happened 10 years ago. There was an investigation but he was never even questioned. Now after all these years they've re-opened the investigation, why? we don't know. He doesn't feel he did anything wrong and believes it was an accident and has already suffered enough from losing his good friend. They were just partying like they'd done many times before. He never thought this would happen. Can the police still lay charges even though it was a total accident, a tragedy that sometimes happens when 2 buddies get together to party and overindulge?

If the survivor procured and or assisted in administering said drug there could be charges filed, but I would assume the clock has run out on that, unless the police were considering murder charges. Murder charges would be very hard to prove from what you have written. Don't speak with the police until you have retained an attorney. Stay with your original statement as to what happened on that terrible evening and that may even be in question due to being under the influence of narcotics and in a state of hysteria over the events. I am not an attorney, and what I have written is just an opinion.
