I already filed chapter 7 bankruptcy and now I'm freaking out about whether I'll be able to find and rent an apartment or keep the one I have. I have a lease so does that mean I can stay? Any ideas?

Yes, if you have a lease and you are not violating the terms of the lease, your landlord cannot evict. Also, landlords rarely run a new credit check when deciding whether to renew a lease. Rather, they base their decisions on how the tenant has behaved during her time in the unit and whether she paid her rent in a timely manner.
On the other hand, if you go out looking for a new apartment, especially if you apply at larger complexes or at buildings with professional managers, they will likely get a credit report and may consider your bankruptcy when they decide whether to rent to you. Not all managers or landlords get a credit report, however. If they do not, and if you do not tell them, they will never know about the bankruptcy. Also, even if a potential landlord does a credit check, if you have a good reference from your former landlord extolling your virtues and explaining how you were never late with the rent, you may still get the apartment. Good luck. For more information or to post a question, visit our Massachusetts Bankruptcy Law Discussion Forum.
