What Should I Do after an Accident or Injury?

I was injured in a car accident (pretty seriously) on a residential street in Massachusetts. I read your article on selecting a lawyer, but I am feeling rushed and confused. I have been contacted by some person who I think represents an attorney (It was kind of a strange telephone conversation). She said I should get an attorney fast. Anyway, what steps should I follow now?  (Posted by Bigsis on The Forum.)

The first thing you should do is take care of yourself and your injuries. Regardless of what anyone tells you, there is no rush to find an attorney. The statue of limitations in Massachusetts is three years for personal injury claims, meaning you have three years to file your claim. Clearly, you should not wait that long, but you get the idea.

 

Once you are ready to move forward, you can look for an attorney you are comfortable with. Until you find that person, don't talk about your condition or your case with anyone other than your doctors and perhaps your personal insurance agent. Most importantly, do not, under any circumstances, sign any document regarding your injury, your accident, or your damages, until you have the document reviewed by the attorney you ultimately select.

 

Some insurance adjusters can be very aggressive in pushing settlements, but you are free to tell them you will consider the matter and get back to them. Similarly, some attorneys, or people who find clients for attorneys, may try to rush you into signing a representation agreement. Don't do it. Take your time and find a lawyer you think you can work with. Good luck.
