Wife arrested twice for domestic assault and battery (11/22 & 1/25/11 - Pre-trial 3/8/11) She has destroyed and/or broken many household items (all verifiable w/ wittnesses, documentation, photos) On Feb. 14 I was served with MA divorce papers (with automatic asset restraining order) and on Feb 19th & 20th she is in the process of moving out (I am staying at a friends while she moves as the court has placed a no contact order upon her- I left on 1/26 to give her time to move) and is picking the house clean. When she is done (as relayed to me via my adult children) it will be 90% empty; down to lamps, pictures, rugs, assessories, bed, t.v., furniture and etc... I have always paid and continue to pay all household expenses.
It would appear that Massachusetts law would now require that we divide assets. Is it reasonable to think that she should receive less than the 50% equity of the home in the division of marital assets?
