I was contacted in September by a unlicensed debt collector. I quickly sent a debt validation letter and received no response. They made a total of about 5 calls attempting to collect on a disputed debt and said they never got my letter. it wasn't until I told them who signed for it that they said my number would be removed from their system and I have not received a call since. They are now listing the account on my credit report, I disputed it, they verified it but do not mark it as disputed. I have disputed it again and am waiting for the results. I also filed complaints with the Division of Banks, Federal Trade Commission and the BBB.
The state told me in a letter to them that they where told to cease and desist and to apply for a collection license in July of 2008 before any collection could be taken in MA. They failed to respond and the state told them that their wilful disregard to the states statutes is alarming and have given them 2 weeks to respond again.
From what I have posted, do you think it would be wise to talk to an attorney about suing them for FDCPA, MA debt collection laws and CH 93A?? I already have an attorney in mind, I just don't want to waste their time if it is not worth it.

I don't think you will be wasting the attorney's time. It will take you five minute to explain the facts and let the attorney decide whether it is worth pursuing, as a 93A claim or otherwise.
