Trying to be fair with divorce agreement

I am trying to come to a divorce agreement with my soon to be ex-wife on money for support. I'm just going to list the facts and hopefully someone in a similar case can provide some advice. Length of marriage: 10 years in Oct 09. Kids(4):10,9,6,5 1 House 1 2nd Mortgage My income:$70,000 Her income:$--- I've run the child support calculator and I am getting a CS number of $420 per week. I am making her car payment $371 per month. (Car is in both names) I am also paying $471 as part of a debt consolidation program we are in. (Again in both out names) Is the $371 and half the $471 considered support? How is the 2nd mortgage handled?

I am willing to let her have the house. We had help, and she should continue to have help from her parents paying the mortgage. She seems reasonable but then at times acts like she is owed 60% of my income. I want to take care of my kids but I need to make sure that I also take care of myself. I'd love to sell the car but: 1. There would be no profit. She and the kids have destroyed the interior and exterior. 2. I don't think she could get another car. She has no income. She is slated to re-fi but in this market and with the 2nd mortgage I am doubtful there will be profit. I am paying the consolidated debt. Some of which is in her name only. But then she is paying the 2nd mortgage. I feel like I am trying to balance a scale one piece of sand at a time.

Editor's Response

I appreciate your efforts to work this out with your wife but, honestly, I do not have enough experience with divorce matters to give you what you need: guidance and a strategy.  I urge you to contact an attorney who does divorce law in MA, sit down with him or her, and come up with a strategy.

If you are committed to trying to work amicably with your wife during this process, think about trying a divorce mediator to help you work though the issues.  Good luck.
