Hello,

I was pulled over in November of 2011 and received a ticket. I promptly checked the appeal on the back of the ticket and mailed it in. Paid my hearing fee on December 13th. It is now February 16th and haven't heard anything I called the court they haven't even scheduled the hearing yet, and I would like to file a motion for dismissal because I don't want to have this ticket hanging over my head. Unfortunately I don't know how to file this motion and I am looking for some advice to get things rolling.

Unfortunately, you cannot file a motion to dismiss a traffic appeal. While you have the right to an appeal, there is no set time that the hearing needs to be scheduled- 2 months is actually not a long time to wait. I have had clients actually wait 10 months from the date of the citation. If you do not want the ticket hanging over your head, the only thing that you can do is pay it. Otherwise, the hearing will be scheduled at the Court's convenience.
