We moved into this house four year ago (new construction) and me and my kids started having health problems almost right away with sneezing and coughing and head aches. We finally fond some mold under a sink and then the inspecter found a lot more that he sais was caused by a leaking joint in the pipe. So is that negligence by the plumber and can we sue him for our personal injury? I don't even know who the plumber was.

If you were exposed to toxic mold due to the negligence of others, that is potentially an actionable "toxic tort." As with all personal injury cases, you would have to establish that one or more parties negligently breached some duty they owed to you and that you and or your family suffered damages as a result.
