Terminated a worker of 7 years for cause, can he sue?

There is not a company handbook or worker files. There was no written termination notice, or anything written. There are emails from the owner detailing his behavior (cleanliness, poor work results, etc.). He was also using a company computer for watching x-rated videos, and was entering the building after hours. How should the unemployment form 1062 be completed and is it worth contesting him getting for unemployment benefits?
