I have a question about tax evasion in Massachusetts, not federal taxes which I think I paid up. I'm not sure I paid I all the state tax I owed and I'm wondering about the penalties for tax evasion. Thank you.

I am certainly not an expert in this area of the law, but I do know there is a huge difference (in terms of penalties imposed) between making mistakes in your return or in the amount you pay, on the one hand, and willful tax evasion on the other.  If you are talking about willful and intentional tax evasion, see Massachusetts General Laws Chapter 62C, Section 73(a):

 

Any person who willfully attempts in any manner to evade or defeat any tax imposed by this chapter or the statutes referred to in section two or the payment thereof shall, in addition to other penalties provided by law, be guilty of a felony and, upon conviction thereof, shall be fined not more than one hundred thousand dollars or five hundred thousand dollars in the case of a corporation, or by imprisonment for not more than five years, or both, and shall be required to pay the costs of prosecution.

 

I would talk to a tax expert ASAP, either an attorney or an accountant, and discuss your situation.  You may be able to file an amended return and put an end to your worries.  If the situation is more complicated, such an expert, with experience dealing with the government in similar situations, can help you navigate the most effective, and least costly, road to correction.  Good luck.  For more information or to post a question, visit our Massachusetts Criminal Law Discussion Forum.
