My son has worked for about 15 years for a national chain of retail stores selling vitamins & nutritional products. He recently moved up the ladder, and is now on salary. However, for the many past years, he never received overtime pay for Sunday work. The company's reason was that there were not more than 3 employees in the store at any one time. Apparently business' with fewer than 3 employees do not have to pay overtime on Sunday. This is a nationwide business however. Does the law really apply to them? Are these stores really considered individual business? I would like to know if he can get back overtime for all the Sundays he worked. Thank You.
