A few years ago I attended a college who advertised that, upon completion of their 1-year program, I would be eligible to sit for national specialist exam and earn credential. Their $10,000 program actually prepares one for a lesser credential which I held at the time of my enrollment. The school misrepresented that their curriculum was more advanced than what I previously obtained from another institution; they never delivered anything new or different. The school has denied my requests for tuition reimbursement. I sent a 30-day demand letter, which they failed to respond to until I filed a complaint with the Board of Higher Education 2 months later. Does their conduct constitute triple damages? Can this be brought into Small Claims? Thank you.

There is no way I can predict if a court would award triple damages in the situation you describe. You mention that you attended the college a "few years" ago. Be aware of the various statute of limitations for claims in MA, including the statute of limitations for 93A claims. If you pursue the matter in small claims court there are jurisdictional limits on the amount you can recover, but those limits have been raised recently. Good luck.
