My son was arrested on a drug possession case and is awaiting trial. He has a court appointed lawyer but he hasn't really talked too much to my son about the case or what we should do about it. I thought I read somewhere that if a person is facing this kind of charge he can ask the judge to stop the prosecution if he agrees to do drug counseling. Is that true and can you tell me what law that is? Thanks.

Stop prosecution in drug possession in MA

You are correct, the law which you are thinking of is contained within chapter 111E of the general laws. However, it is not as simple as your son agreeing to drug counseling, there are a number of other requirements and qualifications. You should have your son speak with his attorney regarding the requirements of chapter 111E to see if it applies to him.
