I'm 15 and my boyfriend is 19. So if we go on dates is that illegal or statutory rape even though we are a same sex couple? Does it matter that MA allows same sex marriage?

Editor's Response

If you are going on a date, like going to dinner or a movie, there is nothing illegal about that.  If you are engaging in any (broadly defined) type of sexual activity then, yes, your boyfriend is committing statutory rape,n a crime in Massachusetts.  It does not matter if you are both of the same sex or that Massachusetts recognizes same sex marriage.  Follow this link for more information about statutory rape in Massachusetts.   And for additional information or to post a question, visit our Massachusetts Criminal Law Discussion Forum.
