I work at a nursing home in Massachusetts in an hourly position. The company requires that I be on call (with a beeper) certain weekends. Does Federal or Massachusetts law require them to pay me when I am on call? (Posted by Trip* on the Forum.)
Neither Federal nor Massachusetts law require payment for on-call employees, as long as there are no constraints on their time and they are not actually paged. On its web site, the Massachusetts Division of Occupational safety says: "An on-call employee who is not required to be at the work site, and who is effectively free to use his or her time for his or her own purposes, is not working while on call and need not be paid."
