First, I am sorry if this question is recorded somewhere. I posted it yesterday but could not find a record of it.
I own a condo in a 30 unit building in Cambridge, MA (the one with the four year roof leak.) A project is being initiated to repair the roof, replace the gutters, and add insulation. I received a bill detailing electrical updates that would need to be done to my apartment for the work to proceed.
I did not vote on whether the project should be undertaken (I would not have waited for the roof repair and possibly not approved the insulation work.) Now, I am being charged an assessment for the work plus being asked to pay for the work to my unit.
Is it necessary for me to pay either cost for a repair I did not even get to approve? (Obviously, I want the roof work done.) I understand MA laws require over 75% of owners approve a repair that is less than 10% of condo's value to make payment compulsory. If the approval is between 50 - 75% then it the cost is paid by those who approved. Would this include the work to my unit necessary to make the project go forward? Do I start by requesting a record of who voted for the repair?

You are talking about a couple of complex issues (repairs vs. improvements and common area vs. individual units). Even if this was my area of expertise (it is not) I really cannot give you any useful ideas without reading your documents and the correspondence between you and the association. Honestly, the best thing you can do at this point, given the amount of money involved, is talk to a MA attorney who does condominium law. Pay for an hour of her time, and let her explain your obligations under your condo documents and give you advice on how to proceed.
