Rolling back or altering odometer under MA law

I bought a car from a small dealer and the guy said the car had 79,000 miles on it like the odometer said but then I got a carfax report that indicates the car has over 100,000 miles on it. I'm not sure I can prove the dealer changed the odometer but how should I proceed? Thanks.

I would start by showing the report to the dealer and requesting a full refund (or partial, if you want to keep the car at a more realistic price).  In cases like this, the dealer usually either knew about the change on the odometer or should have known.  If the dealer refuses to resolve the matter, then you can send a demand letter and, if necessary, seek damages and attorney's fees under the Massachusetts Consumer Protection Act.  Follow this link for a sample demand letter.   A consumer protection attorney can help you with the demand letter and with collecting and presenting evidence if you need to go to court.  Depending on what you discover, you might also talk to your attorney about whether you should make a complaint for criminal fraud against the dealer.  Good luck.
