Rogers Guardianship in Massachusetts

What exactly is a Rogers Guardianship? Is it just another type of guardianship for people who are sick? Thanks.

As you may know, MA law allows one person to become a guardian of another, usually by applying to the Probate and Family Court.  Once appointed by the court, the guardian may assume responsibility for many aspects of the ward's life, including financial and health issues.  There are many types of guardianship for many different classes of individuals (children, the disabled, mentally ill, etc.).

However, even if a guardianship is in place, Massachusetts law requires guardians to seek additional, specific authority for certain types of care and decision making, such as anti-psychotic medication, admission to a mental health facility, or invasive surgery. This additional and separate court authorization is known as a Rogers Guardianship.  Good luck and please tell your friends about The Forum.  For more information or to post a question, visit our MA Elder Law Discussion Forum.
