I live in a small condo building, and we have a retaining wall behind our building. The wall runs past two other buildings as well. On the other side of the wall is a Town building. The building has a road (to lead to parking) that run parallel to the top of the retaining wall. The wall was built long before the town building, and clearly was not meant to support any extra weight from the road. Now the retaining wall is leaning slightly towards our property, and needs to be fixed. Is it the Condo building's responsibility to fix the wall? What if the condo association simply removed the wall, or built a smaller one? Is there a structural easement or obligation of the condo to the town road? Without the retaining wall, the road would not be viable, but there's sufficient land between the building and the wall so that a smaller wall could be built closer to the condo building for a much smaller expense.
