Restraining order sent to Probate Court

I had a earlier post where my ex made false statements to the police in order to have a charge for B & E. She has since used that to get a restraining order against me preventing me from seeing my 4 year old daughter.

We went to the hearing yesterday to see if it would get extended. The judge extended it for 30 days and said to go to probate court and they can deal with the child custody matter there. Last I knew it took at least 6 months to get a date for anything in probate.

I spoke with a lawyer today, he said there was a way to get a emergency filling to be seen sooner? Was wondering if someone could explain that for me.

I would really love to get a lawyer for this matter but the retainer fee is killing me (been told 5 grand for all 3 cases). I can pay that, just not all up front before July 3rd when my hearing is....I was wondering if anyone had any suggestions??? I contacted the legal assistance in Worcester and that they wouldn't be able to help me out.

Depending on the county and judge it can take approximately 2 to 8 weeks to get a hearing in probate court. You may want to seek an attorney that can handle only one of your matters. In the probate court attorneys are allowed to file limited appearances. This means that they only represent you for one specific event and they generally charge a flat fee.
