Repo man on my private property

I'm behind on my payments on my car and the finance company is talking about taking the car back. My question is can I tell the the repossession guy to get off my property and leave the car alone? If I can get another couple of weeks I think I can get the money together since I just started a new job. I always park my wifes car in front of the garage so they cannot get my car out without my help. Thanks.

OK, I'll assume you have talked to the finance company and explained that you have a new job and may be able to make the payments soon.  To answer your question, unless the repossession agent has an order from a judge, you can ask them to leave your property.  Typically, if the finance company has obtained a replevin order, a sheriff or constable will come to your home to get the car, not a repossession agent.  In that case, you cannot object or try to stop the constable from doing his/her job.

Also, if you order a repo agent off your property and he refuses to go, you can call the local police to ask them to remove the trespasser from your property.  In some cases, the police may not understand their role and may try to take the side of the repossession agent.  In that case, politely inform the police that you believe the law does not allow the repo agent to enter your land to take the vehicle without a court order.  If the police are still not cooperative, ask them (again, politely and calmly) to call their superior for instructions.  If that does not work call your Massachusetts consumer law attorney asap and ask her to talk to the police.  Good luck.
