If a broker demands a deposit equal to the first months rent to hold an apartment at the time an application to rent is submitted (but before the lease has been signed/presented), must the deposit be returned if the lease subsequently contains provisions that would seem to prohibit the tenant from renting the apartment?
In other words, say, I must pay a $2000 check to a broker at the same time that I fill out a rental application/credit check form. After being approved, the lease (which was not previously available to me) contains provisions that prohibit me from living there. For example, it says "no motorcycles" or "no pets" or "no musical instruments", despite that fact that I own these items, but was not previously informed that they would not be permitted.
