I'm looking at renting an apartment represented by an agency. They want me to pay $100 for the rental application (credit check, etc), nonrefundable. Is this legal? Is it unusual? Also, they want it in cash. Doesn't sound good to me.

I believe rental application fees are illegal in Massachusetts. If the landlord cannot charge a fee, I doubt a court would allow the agent to charge an application fee. Some specialist in this area advice tenants to avoid paying the fee but, if they really want the apartment, to pay the fee and then deduct if from the first month's rent. That doesn't seem like a great way to start the landlord/tenant relationship, but I guess your options are limited. I suppose you could try talking to the agent and/or the landlord and explain your position that the fees are illegal, ask them to waive it, and see how it works out. Good luck.
