My daughter insists on going to a fortune teller in the town where she lives, in Massachusetts. I worry about her wasting her money on this crook, but she refuses to listen. Why are fortune tellers even allowed? Are they regulated at all by Massachusetts law?

Editor's Response
Not much. State law requires fortune tellers to be licensed, and they obtain those licenses from the local town or city government. Massachusetts General Laws Chapter 266, Section 75 prohibits the act of fraudulently taking the property of another by "game, device, sleight of hand, pretended fortune telling or by any trick or other means by the use of cards or other implements or instruments." Also, MGL Chapter 140, Section 185I prohibits anyone from obtaining a license to be a fortune teller unless they "have resided continuously in the city or town in which the license is sought for at least twelve months immediately preceding the date of the application."
In answer to your second question, I can only guess that our leaders see fortune tellers as a legitimate form of entertainment. For whatever reason, many people seem to enjoy using their services. For more information or to post a question, visit our Massachusetts Consumer Law Discussion Forum.
