After putting down several deposits for our wedding (scheduled for June, 2011), my girlfriend and I broke up and called off the wedding. So now I've been trying to get refunds from a photographer and the function hall at a hotel. The photographer gave me the deposit back without any problem but the manager of the function room for the reception says we have to forfeit the deposit to cover their expenses for finding a new customer. Really? This is a high class hotel in JUNE! There is no way they will have trouble filling the date. So can I sue them to get the money refunded?

Refunds after wedding cancelled
You will need to look at the terms spelled out in your contract, specifically any terms regarding a refund policy. The contract will control. If there was no contract, or if the terms are ambiguous, you may want to sue in small claims court to try to recover the damages. Honestly, I have no idea what people normally put down as a deposit for a wedding, but if you put a large sum down, you may want to discuss the matter with a MA consumer law attorney. Even if the terms of the contract appear to favor the reception hall, a well written letter from an attorney can often convince a business that they are better off compromising than spending money to defend a law suit.
