In Massachusetts, if you raise the rent and in order you have to start a new tenancey agreement if they owe money do you forfeit that money because of the new agreement. In other words you are ending the tenancey and starting a new one for more money.

Hey dirtyharry, are these the same tenants you are trying to evict? If so, I would tread very lightly. This may be misconstrued as abuse to get them out if you raise the rent. I know it stinks to have them in there but after you serve them the notice to quit I would not talk to them AT ALL (even though its the hardest thing to do, believe me)or do anything because they can retaliate and they will get more time to stay without paying. we saw TONS of tenants getting restraining orders on the landlords just for saying "when are you moving out" or "have you found a place yet". They all won and were allowed more time to stay. Good luck and I hope you make out good! Keep us posted.

Thanks again you have been helpful, there is nothing much I Have not seen with the bad tenant , they will strike when you least expect it but they want you to feel bad for them when they have no cash, I Have seen people set up people just for that reason they are scum. and Iam Catholic but it wears you thin .
