My husband lives and works in MA for a company which is based out of state but has local offices. His health insurance is provided for by an out of state health insurance company. They claim that since they do not take MA state funding, they are not subject to MA health insurance coverage laws. Is this true?
I am specifically referring to the law which requires coverage for medically necessary expenses of diagnosis and treatment of infertility to persons residing within the commonwealth - Chapter 175: Section 47H. Are they not subject to this MA law even though they provide coverage to persons residing within the commonwealth? Are they not legally required to to provide infertility coverage?
