Property Damaged by Fire on Neighbors Property

My property experienced damage due to a fire at my neighbors property. How do I recover the difference between what my Insurance is willing to pay after prorating the repair cost? Do I need to file a Law Suit?

If you are asking about suing the insurance company, that would likely be some form of contract claim.  You should look at the insurance policy for any mention of alternative dispute resolution options or requirements, such as arbitration.  If you are asking about suing another person, such as the owner of the building or the person who caused the fire, that is a negligence action.  In that case, the answer is very similar to one I just posted about damage caused by ice on neighbor's roof.  If nobody was negligent, you don't really have a claim.  However, depending on how much money you stand to lose, you should probably discuss this matter with an attorney.

Thank you for replying. I will review my insurance policy. I guess I was questioning how to begin an action with the owner or insurer of the other property. I was told by my home insurance adjuster that my insurer will not seek any action against the other company.
