MA Personal Injury Law Questions and Answers

I was in a parking lot pulling something out of the trunk of my car when I was hit from behind by another vehicle. Whose pip benefits should pay for my medical expenses? Mine or the other vehicle? Technically, I was "outside" of my car.

Sorry about your injury, but that's a pretty interesting question. Obviously, you should talk to your insurer, but I would argue that you were a pedestrian in that case. As you may know from reading our other posts, in cases where a pedestrian is hit the PIP insurer of the driver of the automobile covers the medical bills.
