Me and my friend were attacked by some people he knew when we were walking together last month. One of the people (I know their names) grabbed my arms and held me while the other two hit my friend several times. Then the guy threw me on the ground and they all left. I was yelling the whole time and told this guy to let me go. Can I sue the guy who was holding me? I got some big bruises and a cut on my head and was terrified and embarrassed by the whole thing.

Yes, you could certainly maintain a civil suit against your attacker for assault and possibly for some other types of intentional torts, depending on the facts. Follow this link for more information about assault and other intentional torts in MA. You should talk to a MA personal injury attorney to discuss your damages and whether it would be worthwhile pursuing the matter. You also have the right to go to the district court and swear out a criminal complaint. There is no guarantee that the district attorney will prosecute, but, given the frightening facts you present, I would be willing to bet that the clerk magistrate will find probable cause to charge the person and the district attorney will prosecute. Just a guess, though. Good luck. For more information about assault and other torts, visit our Massachusetts Personal Injury Discussion Forum.
