The father of my six month old is in jail for the next year or so. He wont tell me how long and he says he isn't taking a paternity test and I can't make him because it would violate the civil rights of a prisoner. I'm pretty sure that this is his usual BS. Is there any way that I can force him to do the tests even if he is in prison?

Yes. When a man refuses to do a paternity test, whether he is in jail or not, the mother can obtain a court order requiring him to submit to the test. Given that the father is incarcerated, it is probably best to contact a MA family law attorney in this case. You will need to file a Complaint to Establish Paternity. Once you jump through all the hoops, the Court will order a genetic marker test and your former partner will be required to complete the test. Good luck.

I agree with the Editor. You can also contact the Massachusetts Department of Revenue. Chances are if the father is in jail he is not paying support either. They can help you establish paternity and support. Here is a helpful link to their site. http://www.mass.gov
