My friend is the employee, his father is the employer. He had done some work about a year ago on contract and the work was compleated. The company he did the work for had some legal battles that held my friend up from performing work. As time went on the guy he did the work for wanted extra things done, after everything was compleated, he refused to pay for the extra work, though he did admit to pay in front of 4 people in 2 weeks.
It has now been a year and my friend gave him one last chance but the guy still refuses to pay. He said he will use an affidavit in court, small claims, to say that my friend took too long, when in fact the person supporting the affidavit failed inspection 3 times.
Does my friend have the right to sue under CH 93A? Also if the person for affidavit is not present in Small Claims Court and the Affidavit is not notorized, is it admissible or is it hearsay?
