I am currently 26, when I was around 13 years old, I was arrested in school for possesion on live ammunition (I bought 2 bullets off a kid with intention of keeping them for a collection). Unfortunatly it was horrible timing to get caught as this was right around the Columbine Incedent.

The police in my town went all out on charges, there was quite the list. After many court hearings it was eventually dismissed due to much wrong doing on the police departments part (charging me with possesion of a firearm when I didn't actually have a gun, and never verifying the roungs were live, and a bunch of other issues the lawyer noticed). I was told that it was to be expunged and that it shouldn't show up. However when I had a interview for a job it came up (they did a background check and it showed I was charged but not convicted for a felony).

I went to the court that I had everything done at, but they said there is no record of it in my name, they had me check with the county court as well and still nothing.

Is there any suggestions on how to clear this up? I mailed the forms to get a copy of my CORI check but I'm still waiting for that.

Expunge criminal records

This is not an area of the law that I am terribly familiar with, so I can't offer any information.  I would be curious to know where the employer got the information and what the CORI says.  The best source of information I am aware of of for this topic is the MA trial court law library.  Good luck.

Sealing/ Expunging a Juvenile Record

Under Massachusetts Law, as long as you have not been found guilty of a criminal offense in Massachusetts or any other state in the last 3 years, you can file a petition with the commissioner of probation to have your juvenile CORI sealed. After that, only law enforcement may still see that there were entries on your juvenile record. Based on what you are saying, there may be grounds to have the case "expunged" from police records. The effect of expunging your record is to literally have it destroyed. However, this is only available in very rare and specific circumstances- one being a juvenile case that was dismissed due to insufficient evidence. Even if expunged from police records, it can never be expunged from your "CORI" through the probation department, but again, it may be sealed, which would serve to have "no record" show up on any CORI check, other than that by the courts or law enforcement. www.urbelislaw.com
