WE have been facing numerous problems such as roof leaks and other such issues with our new construction. Condo owners have made several attempts to notify the developer, who makes it a point not to respond. Association will only take over in August. Is the association resoponsible for assesment charges - even if reasonable efforts have been made to contact Developer?

If this a new construction and the turn-over event has not yet happened, repairs and the associated costs are the responsibility of the developer. If this is negligent contruction, the unit owners should not be bearing the cost. If this is normal wear and tear, the case may be different.
If this is new construction, and you are unable to resolve this matter with the developer before the turn-over event, the association may be able to sue the developer under warranties that law requires the deveoper to provide.
