In late November of 2006 I moved from Cape Cod to Boca Raton FL. Before doing so I cancelled my cable and attempted to cancel the electricity. I called NSTAR to make payment arrangements and to shut off the service, howver I was told that being almost December and having electric heat to have the owner call and set it up in his name. The owner owns many units and I know him personally. While is Florida, about a week later, I called the landlord to check in and make sure all was ok with the move out. The place was a shit hole when my husband and I moved in, we put a lot of labor into it, tore up rugs, painted 1960's cabinets, made a beautiful yard......he was pissed at me, said that I had left a bag of trash in the basement and that my cat had put a tear in the screen. I said "are you kidding me?" We got into it and he said "you'll get yours." I did too. He ran the electric on high for 2 months and it cost $1300.00. I was never put into his name. On Feb 1st a new tenant moved in and put it into their name. It clearly shows malice on his part for the amount to be that high. I have a Florida lease, I got a Florida licence, bought and insured a car, had utilities turned on too. I have been taken to court by NSTAR and lost because I was unaware of the law suit in small claims court. When I did finally find out I called NSTAR and their attorneys, all were of no help. Please advise me. I have severe rheumatoid arthritis and do not work any longer. I do not collect any funds from anyone, just my husband.

Sorry about the mess you find yourself in, but I really don't have any good answers for you. Most of the options for dealing with the mess in court (suing landlord in small claims court or moving to have the judgment set aside for insufficient service) will, eventually, require you to be up here or to hire someone to go to court for you. If you go to the website for the small claims court, you can find forms for a general motion, which you can use to try to have the judgment set aside.
Not clear on what happened with the electric company and why they didn't turn of the electric. Depending on the facts, you may want to talk to the Attorney General's office to file a complaint and see if they can put some pressure on NSTAR.
