Last Sept. my girlfriend and I signed a 12-month lease for a house that was turned into an apartment. Our landlord is an elderly lady who lives above us. Because of her age, her son takes care of the business and repairs concerning the property.
Well, recently we have been hearing noises in the cellar. Come to find out, her son lives below us. This bears a few problems for us:
1. We do not have access to our fusebox and we've blown a fuse a few times, which is a simple fix, but if he's off to work we have to wait until he gets home to flip a switch.
2. We can hear what him and his guests say clear as day in our bedroom, which is unsettling.
3. He's doing contant repairs at various points throughout the day and night.
Now, we were never notified about this and if we were, we would have never signed the lease. It's also not in the lease that he lives on the premises. There is also a noise clause in the lease, does that also apply to him?
Should they have/have the legal obligation to tell us that he was living below us before we signed the lease? I explicitly remember during the walk through that he was vague as to what was in the cellar, but I know in court that would be considered hearsay.
Overall, we feel a little slighted and deceived here and we want to know if this constitutes any legal action.
