My husband and I are renting in Brookline. the neighbors upstairs are very noisy between the hours of midnight and 4am ( stomping on the floor moving furniture - loud TV). When we moved in we were told there were 4 people on the lease and living there, there are now 9 people living in that apartment - which is way too many people. When I told the landlord she said she only knows 4 of the people living there. She asked me to take a photo of the mailbox that lists all 9 people and she would call them to tell them to keep the noise down. I fear that her giving them a warning is not enough and for the past 3 months my husband and i sleep 3 to 4 hours a night and it is now starting to effect my performance at work which is not fair. In this economy I do not want to get fired. If I keep complaining to the landlord and keep telling the neighbors to be quiet and they donot comply what options do I have? if at all?

I looked but i did not see anything about what the law says about 9 people living in one apartment in the stat of Mass. Also if the landlord is unaware of five of the people living there full time. Is there a law?

From the landlord's perspective, I would certainly think the number of people living in the apartment would be a concern. However, from your perspective, it does not matter. What matters is whether the people living in the unit (one or nine of them) are creating so much noise that they interfere with your quiet enjoyment of your unit. You might also ask the police to investigate when the noise is loud.
If you believe the noise will stop or diminish if you are able to get rid of some of the tenants, then I suppose you could try contacting inspectional services. The state sanitary code does limit the number of people that can live in a unit (based on square footage), but I have no idea how inspectional services would respond or even how you would prove that their are nine people (since I doubt very much they put all the names on the mailbox.)
