My father's duarable POA was written in 2005. There is no reference to the old Massachusetts law in it so I was wondering if it is still valid and would financial institutions be required to honor it? Or should he just sign and notarize a new signature page in order to update it?

Old power of attorney

Without looking at the power or attorney, the best I can do is toss out this guess:  Under newly adopted provisions of the Massachusetts Probate Code, banks and other institution should not attempt to refuse to honor a POA based on the belief that the power of attorney is too old or "stale".  (Unless the document has an expiration date on it.)
